Reasons
Erika Holloway, a 麻豆原创 member, agrees to the following outcome of the investigation into a complaint of a failure to meet the Professional Standards under reference PCP[鈥
1. Background
1.1 Ms Holloway has been a 麻豆原创 member (the Member) since [鈥.
1.2 The Member is in private practice.
1.3 [鈥, the Complainant [鈥 who was a client of the Member made a complaint to 麻豆原创 about the Member鈥檚 professional conduct. The Complainant alleged that the Member had made inappropriate comments in sessions, in particular stating:
a. 鈥淲hat colour is he?鈥 when discussing a relative of the Complainant.
b. 鈥淎s my black supervisor said鈥︹ when the reference to the supervisor鈥檚 colour was not relevant.
c. 鈥淲ait, this isn鈥檛 a black church?鈥 when discussing the Complaint鈥檚 experience of racism in church.
1.4 It was also alleged that the Member had failed to provide the Complainant with a written record of the contractual terms agreed.
2. Admissions
2.1 The Member makes the following admissions which the 麻豆原创 accepts:
Allegation 1
1.1 The Member failed to demonstrate respect for the Complainant by making the following comments (or words to that effect):
a. 鈥淲hat colour is he?鈥 when discussing a relative of the Complainant.
b. 鈥淎s my black supervisor said鈥︹ when the reference to the supervisor鈥檚 colour was not relevant.
c. 鈥淲ait, this isn鈥檛 a black church?鈥 when discussing the Complainants鈥 experience of racism in church.
Allegation 2
2.1 The Member failed to provide the Complainant with a written record of the contractual terms agreed.
3. Mitigation
3.1 The Member puts forward the following in mitigation, which has been taken into account by the IAC in deciding the appropriate outcome:
鈥 The Member says she has reflected deeply about this complaint
鈥 The Member is sorry that the work with the Complainant ended in the way it did
鈥 The Member recognised that she could have done better in parts.
鈥 The Member believes that she will keep on learning from this experience. The Member ensures that she is up to date with CPD, as required by 麻豆原创.
鈥 The Member intends to book the 麻豆原创 course: 鈥榃orking with race and racial identities to support ethical practice,鈥 to help inform her work.
4. Conclusion
4.1 The issues identified and admitted by the Member amounted to breaches of the Ethical Framework in particular:
1. Paragraphs 22a and c: We will respect our clients as people by providing services that: a. endeavour to demonstrate equality, value diversity and ensure inclusion for all clients; and/or c. accept we are all vulnerable to prejudice and recognise the importance of self-inquiry, personal feedback and professional development; and
2. Paragraph 31d: We will give careful consideration to how we reach agreement with clients and will contract with them about the terms on which our services will be provided. Attention will be given to: providing the client with a record or easy access to a record of what has been agreed.
4.2 One of the aims of the Professional Conduct Procedure is to protect members of the public. The IAC in considering the appropriate outcome and sanction for the admitted breaches in this case have taken into account the interests of public protection and determined that it is reasonable and proportionate to conclude it by agreement on the terms set out below.
4.3 In relation to the finding above the IAC considers it appropriate that the Member is required, within two months of the date of this agreement to provide to 麻豆原创:
1. Evidence of successful completion of the identified course: 鈥榃orking with race and racial identities to support ethical practice鈥, together with evidence of completion of a further 6 hours of CPD on working with issues of Equality, Difference and Inclusion.
2. A written reflection addressing:
a) What went wrong in this case;
b) Her learning from the complaint and the CPD undertaken;
c) Her understanding of the impact of her behaviour on the Complainant and the counselling profession;
d) The changes she has made to her practice to prevent a repetition in the future.
3. A letter of apology addressed to the Complainant which accepts responsibility for what went wrong in this case and acknowledges the impact on the Complainant.
4. Confirmation that her CPD, written reflection and letter have been discussed with her supervisor.
4.4 The Member agrees that this Agreement will be published by the 麻豆原创 in line with the Publication Policy and that it will be disclosed to the complainant.
4.5 The Member agrees that she will not act in any way inconsistent with this agreement such as, for example, by denying the finding in paragraph 2 above.
4.6 If the Member fails without good reason to comply with the sanction set out above or acts in a way which is inconsistent with this Agreement the matter will be referred to a sanction panel for consideration. The decision of the sanction panel may be published.
4.7 If the Member acts in a way which is inconsistent with this agreement, her membership will be terminated. Such a decision will be published.
